Raising questions on the agreement between Congress and Patidar leader Hardik Patel on the issue of reservations for the Patel community, BJP said that the two are cheating each other on a matter which is not legally endured. Finance Minister Arun Jaitley said that both of them are cheating each other at the Congress-Hardik Club. This reservation is a violation of the 50 percent limit, which is not possible under today’s law, by legal and constitutional forum. He said that only such promises should be made in the elections which can be implemented.
Jaitley said that the law is quite clear and the Supreme Court has given the arrangement in this regard. In the judgement of the Supreme Court in the Mandal Commission case, it has been said that the total reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes or Special Category cannot exceed 50 percent. Referring to the unsuccessful efforts of the Gujjars in Rajasthan, he said that the judiciary has again proved that the limit of 50 percent cannot be extended.
